The incident began when the officer approached the car and asked if the driver knew why he had been stopped. The driver replied that he did not, and the officer explained that his registration had expired on June 30, 2016. The officer then requested the driver’s license, registration, and insurance card.
Keeping his hands firmly on the wheel at the 10 and 2 positions, the driver immediately took a proactive step for safety. He informed the officer: "For your safety and mine, officer, I want to let you know that I am legally carrying a firearm. I have a concealed carry permit, and my gun is in the small compartment under the cup holder, with a round in the chamber and the safety on. There is also an extra magazine with it."
The officer, understanding the situation, asked the driver to keep his hands on the wheel and inquired about the location of the firearm. The driver responded calmly, offering to step out of the truck if necessary to allow the officer to retrieve the weapon. The officer agreed and thanked the driver for his cooperation.
When the driver exited the vehicle, the officer positioned himself to ensure he was facing the driver for safety. At this point, the driver took the extra step of asking if the officer wanted to search him for other potential weapons. The officer appreciated the offer and asked whether there were any other firearms or weapons in the truck. The driver assured him there were none.
The officer then conducted a search and retrieved the handgun. He asked for permission to retrieve the driver’s license and concealed carry permit from the wallet, and the driver gave his consent. The driver even offered to allow the officer to search the rest of the truck, though the officer declined.
Once everything was settled, the officer handed the firearm back to the driver, who instructed him to place it on the driver’s seat so that he could retrieve it later. The driver thanked the officer for maintaining his calm throughout the interaction, especially given the presence of the legally carried firearm, and the officer reciprocated the gratitude. After signing a warning ticket, the officer reminded the driver to update his registration soon.
